Austin Wuennenberg, 21, of Kissimmee, died of multiple traumatic injuries in the July 2009 incident. In a 911 call, a witness described the crash as "a head-on collision" between two trains.

The accident occurred as the park resort was closing and one train was being transferred off the rail line.

A fine issued to Walt Disney World by the federal workplace safety agency was initially set at $44,000, but it was reduced by 20 percent in January, to $35,200.

OSHA and Disney signed a settlement agreement in December for breaches contributing to death of Wuennenberg , as well as other workplace violations.   A Disney spokeswoman said the resort worked with OSHA to address any concerns but declined to comment further.  Under the agreement, Disney said it would correct all four safety violations cited by OSHA.

Disney's monorail system is controlled by a central dispatch. A former Disney monorail pilot said there is a safety system that is supposed to prevent two trains from ever getting that close to one another.  Nearly 7,000 guests per direction, per hour ride the monorail. On a typical day, more than 150,000 guests utilize monorail transportation.
