The man accused of gunning down a father outside a Dunwoody daycare center is expected to go on trial in October.
A judge made the decision at a DeKalb County courthouse Thursday morning.
Prosecutors say Hemy Neuman shot and killed Russell Sneiderman last November after Sneiderman dropped off his young son at Dunwoody Prep.
In police documents, investigators say Neuman and Sneiderman's wife -- Andrea -- were in constant communication in the days before and after the murder.
Neuman was Andrea Sneiderman's boss at General Electric.
Police have not released a motive for the murder.
Neuman's wife has filed for legal separation, alleging her husband was having an affair.
