Criminal case against Casey Anthony off limits in upcoming civil trial

The civil defamation case against Casey Anthony went before a judge Thursday morning.  Anthony's attorneys do not want Zenaida Gonzalez's attorneys to talk about last summer's murder trial against their client mentioned in this case. 

"We are seeking to exclude that is not authenticated that's not a probative issue that unduly  prejudicial," said attorney Charles Green, who represents Anthony in the civil case.  "By talking about it, by making reference to it you can mislead and poison the jury by making them think it's relevant," said Green.

The two sides have not agreed on much in this case. To everyone's surprise, including  that of the judge,  they do on this issue.  "We're not going to go in and say, 'Members of the jury, you remember the criminal trial.  Now, here's the civil case.'  That's not the way it works.  We're not going to do that," said John Dill, a member of Zenaida Gonzalez's legal team.  

Both sides agree the only time the criminal case against Casey will be brought up, will be during jury selection.  Lawyers on both sides will need to know what potential jurors know about Casey Anthony and what they think about her and if they'll be able to listen to evidence without prejudice in the civil trial.  Judge Lisa Munyon spelled out the only exception. 

"If you believe something becomes relevant, you ask to approach and we discuss it," said Judge Munyon.

The next big issue at hand is that Anthony's lawyers want this defamation case moved out of Orange County.  "We're in the process of gathering data as to where a more appropriate venue would lie.  There are places in Florida outside of Orange County where saturation of coverage about Casey Anthony has not been much," said Green.

Where those places are and if the civil trial will be moved, those are issues to be debated at the next hearing on October 30.
