Suspect in fatal hit-and-run of Henry Co. officer denied bond

The suspect in a deadly hit-and-run made his first court appearance on Wednesday. A Henry County judge denied bond to 43-year-old Ruben Marin-Garibay, who police say was driving a truck that hit and killed a Henry County officer and injured another person.

During his court appearance, the shackled Marin-Garibay asked for a public defender.

Marin-Garbay's wife was present for his appearance but she had no comment to FOX 5 concerning his charges.

Based on a tip, Henry County Police and Georgia State Patrol arrested Marin-Garibay of Stockbridge on Tuesday night, according to police.

Authorities believe Marin-Garibay was driving a truck that struck and killed 53-year-old Henry County Police Officer Elgin Daniel and sent another victim to the hospital on Monday night. Daniel joined the Henry County force two years ago after he retired from the DeKalb Police Department with more than two decades of service.

"We're very pleased to be able to make an arrest this early in the investigation," said Major Jason Bolton of the Henry County Police Department.

Officer Daniel was killed when he stopped to help an insurance roadside assistance employee who was delivering gas to a red Mustang.

"I was standing behind the car, and they were on the side and I was waving traffic away. The next thing, there's two bodies going through the air," said Gordon Jarrett, the owner of the Mustang that was out of gas.

Paramedics rushed both victims to Atlanta Medical Center. Officer Daniel was later pronounced dead.  The injured man, 58-year-old John Cook, was listed in fair condition on Wednesday.

Police said the driver of the truck sped away after striking the men.

Witnesses said that investigators arrived at a home in Stockbridge around 5 p.m. on Tuesday and inspected a white truck. Marin-Garibay, who lives at that home, was arrested a short time later.

The hit-and-run suspect is originally from Mexico but became a naturalized citizen in 2001. Officers say he appears to have no criminal record and owns a tile business.

The white F-350 truck was taken away by authorities on Tuesday night.

Marin-Garibay is being held without bond at Henry County Jail. Marin-Garibay is charged with vehicular homicide, serious injury by vehicle, failure to maintain lane and hit & run, according to Bolton. His next court appearance is set for December 11 at 8:30 a.m.
