Little Falls man who shot, killed teen intruders released from jail

LITTLE FALLS, Minn. (KMSP) -

Byron Smith, the Little Falls homeowner who shot and killed two teenagers in his basement on Thanksgiving, was released from jail Tuesday morning when he posted $50,000 cash as conditional bail.

On Monday, a Morrison County judge sliced the original $2 million bail for the 64-year-old, bringing it down to $500,000 bond or $50,000 cash.

Smith surrendered his passport as a condition of his release. He has no prior criminal record.

Smith admitted to the deadly shootings of 17-year-old Nick Brady and 18-year-old Haile Kifer after they broke into his home. He has been charged with two counts of second-degree murder in what authorities describe as an ambush-style killing.

On Monday, prosecutors gave the first glimpse of what the audio recording system inside Smith's home captured the night of the double-shooting. The assistant county attorney said Smith can be hear taunting the dying teens, firing multiple times, and taking just 18 seconds to wrap Brady's body in a tarp before waiting for Kifer to come down the stairs before shooting her as well.

Under Minnesota law, a homeowner can use deadly force on an intruder if a reasonable person believes the intruder intends to inflict harm. Smith told investigators he was afraid the teens might have a weapon, but prosecutors say he went too far.

"The law doesn't permit you to execute someone once the threat is gone," said Morrison County Sheriff Michel Wetzel. "When it becomes clear there's no threat to you, and a felony can't be committed in your home, you no longer have the right to shoot someone."

Smith's attorney, Steve Meshbesher, told FOX 9 News on Monday to say the original bail amount was too extreme for his client. As he argued to have it reduced in court, several friends and loved ones of the two teens were overcome with emotion during the hearing.
