
The Florida Highway Patrol says it cannot determine if a man killed in a
motorcycle wreck on Wednesday, January 9, in Windermere, was texting
while driving.
FOX 35 previously reported that the driver had been texting. Kim Montes with the Florida Highway Patrol says witnesses told the troopers on the scene that they saw what appeared to be a phone in the 40-year-old driver's left hand prior to the crash and troopers found a broken cell phone at the scene.
With no charges filed, troopers say they cannot subpoena the motorcyclist's phone records to see if he was texting.
The accident happened just after one o'clock in the morning. The driver was riding south on Chase Road and lost control on a curve. He veered into the northbound lane and crashed into another vehicle. The person in the other car was not injured.
