No charges in shooting of man who clung to moving car

Deputies said Nikki McNeil and Lamark Tucker recently ended a relationship through which they have three children together. 

When McNeil, 33, dropped the kids off at their Ocala home on Saturday night, deputies said Tucker, 36, got angry with McNeil. 

"Apparently, he wanted to talk about the relationship.  She didn't want to have that," said Officer Judge Cochran with the Marion County Sheriff's Office.  "She tried to leave. He took her key, he took her cellphone."

Deputies said McNeil walked the kids inside the home.  She happened to have a spare key to her car, so she got in the vehicle and drove off.  As McNeil drove away, deputies said Tucker jumped onto the car.  McNeil drove 10 miles around the area with Tucker hanging onto the car.  At one point, deputies said McNeil thought Tucker was reaching for a gun, so she pulled out a gun and shot him once through the windshield.   Tucker fell to the ground and died near a Kangaroo gas station on CR 25-A.

After gathering evidence and interviewing witnesses, there will not be any charges in the fatal shooting.

"We're satisfied, at that moment, that her story played into a situation where it was not necessarily foul play, and she didn't necessarily have to be placed under arrest," Cochran said.

Two days before the shooting, a Marion County judge dismissed a domestic violence injunction which McNeil had filed against Tucker.   According to court records, McNeil decided not to pursue the restraining order.
