Trial of former OPD officer accused of killing son begins

ORLANDO, Fla. (WOFL FOX 35 ORLANDO) -

Opening statements began on Monday in the case against a father accused of second-degree murder for shooting is own son.

Prosecutors opened by telling jurors that former Orlando police officer Timothy Davis Sr. "lost it" following an argument with Timothy Davis Jr.

"You will hear from the defendant himself, his own confession, that he killed his son, because he lost it," said prosecutor Jim Altman.  He went on to say, "He lost his cool, he lost his temper, he lost control."

Defense attorney Richard Nesmith said Davis Sr. feared for his life after a fight with his son carried outside the house.  He said Davis Sr. was beaten until both of his knees gave out on him and he collapsed.  

"This isn't a case of 'Who did it?' but more so 'why?'" 

Prosecutors played an interview with Davis Sr. recorded by Apopka police detectives on the day he shot and killed his son.  Davis Sr. told investigators he was in a daze after the fight saying, "I just lost it and I'm not proud of it, because I pride myself on being a man and being a cool level headed person."

Prosecutors will continue their case tomorrow.  Arguments will begin on whether or not the jury will get to go to the home of Davis Sr.
