CHICAGO (FOX 32 News) -

A Broadview elementary school teacher was arrested last May for allegedly duct-taping a fifth-grade student's mouth shut. The 11-year-old boy's mother recently filed a lawsuit against the teacher.

Sarah Marie Hicks, 28, taught fifth grade at Lindop Elementary School in Broadview. An investigation into the February 2012 duct-tape incident resulted in her arrest for alleged battery.

The suit names Hicks and Lindop School District 92 as defendants, and seeks more than $100,000 in damages, saying the boy has suffered anxiety attacks and nightmares since the incident.

The case is pending in the Maywood Circuit Court in Cook County, and Hicks is currently on leave without pay.
