New allegations surface in the West Memphis 3 murders

Routine hearing to allow one of the victim's mothers, Pam Hicks, to be allowed to view evidence in her son's murder case but after her attorney looked into the prosecution's case file; he says they discovered scathing evidence.  It's evidence he says the prosecution has kept quiet from the public, until his team brought it to light.

David Jacoby, accused says, "feels like a railroad since 2005 when I was first drug into this."

David Jacoby denies allegations which accuse him along with three others in the 1993 West Memphis Three killings.  But attorneys for two of the victim's parents say eyewitness testimonies and detailed confessions prove otherwise.

Danny Owens, legal assistant for Pam Hicks attorney says, "These people have been trying to come forward, fought to forth for over 20 years and these people were not heard."

The accusations point the finger at one of the victim's stepfather's Terry Hobbs, Jacoby and then-teenagers Buddy Lucas and L.G. Hollingsworth.  One of the most scathing implications is provided by Bennie Guy, who once lived with Lucas.  During two separate instances, Guy says Lucas confessed to the killings.  While Guy says he was still skeptical, a jailhouse confession of the murders moved Guy to call authorities but nothing happened.   

Ken Swindle, Pam Hicks' attorney says, "Prosecutor Ellington has the evidence to prosecute real killer, not doing it."

According to Guy's affidavit, Hollingsworth said the group spotted the three boys after smoking weed and drinking whiskey.  Hobbs demanded they catch the boys.  But after one of the boys kicked him, Hobbs became enraged and started to beat the child.  Then the others started to severely beat the other two boys.  According to the Affidavit, Hobbs forced Hollingsworth and Lucas to strip the boy's pants off, and then Hobbs cut the groin of one child and then tossed the boys bodies in a ditch.  Guy says Hollingsworth showed no remorse.

Mark Byers, father of victim Christopher Byers says, "there's a guilty party in this room, today, that helped kill my son and it's all I can do to grab a hold of him."

Jacoby says he's no longer in touch with Terry Hobbs and says he doesn't know the other two accused in the murders.  But he admits he does regret not reporting a gap in time during the first day of the search. 

Jacoby says, "there was a window Mr. Hobbs wasn't with me and I never spoke out on that because I'm thinking West Memphis 3 was railroaded how hard would it be to railroad him if I was to say he was missing for a couple of hours."

While Pam Hicks lawyers say they want the state to prosecute the four people responsible, one of the West Memphis 3 says he's cautious of knee-jerk reactions.

Jason Baldwin says, "all the ‘he said', ‘she said'…that's not real evidence cause people can say anything."
