NJ cop's lawyer: Shooting was self-defense

The New Jersey detective accused of shooting and killing a motorist on the side of a road in Maryland is free on bail.

Detective Joseph Walker of the Hudson County, N.J., Prosecutor's Office was charged with second-degree murder in the death of Joseph Harvey Jr.

His lawyer is calling this a clear case of self-defense.

Walker was with his wife and three small children when Harvey and a second man walked up to Walker's minivan. Walker had gotten out of his van.

Walker's defenders, and there are many, allege there are several things that have not come out and that this is a case of self-defense. They say that witnesses say Walker told Harvey that he was a cop three times and showed him his badge.

Secondly, they say that Harvey made racial slurs against Walker and his wife on the highway.

Thirdly, that Walker's wife called 911 before the shooting.

And that the man killed, Harvey, who was 5 feet 11 inches tall and 290 pounds, had been convicted of first-degree and second-degree aggravated assault. The second man is also large, and that both charged Walker after he took out his pistol and might have taken his gun had he not fired, according to Walker's attorney.

Walker's fellow officers and his police union are supporting him. They noted that this killing does not match his personality.

Walker has been suspended without pay, so the National Police Defense Foundation is trying to raise the expected $250,000 needed for his defense.

The Maryland state attorney involved in this case was just named an interim attorney there and is seeking reappointment in 2014. The office would not comment on the details of the case. A spokeswoman for the Maryland State Police said the case is ongoing. It is expected to go before a grand jury within a week.
