Suspect remains jailed, denies he shot 7-year-old

ATLANTA -

A 28-year-old man who denies he fired the shot that critically injured a 7-year-old boy was expected to make his first court appearance in connection with the shooting Tuesday morning.

Elrico Smith turned himself over to police custody Monday, just hours after the Atlanta Police Department released his mugshot to the public. He's charged with aggravated assault with a weapon, second-degree cruelty to children, possession of a firearm during the commission of a crime and possession of a firearm by a convicted felon, police said.

Smith waived his court appearance. His next is set for July 9. He remains Fulton County Jail, being held without bond.

On Monday, when asked if he had anything to say to the child's family, he responded, "Yeah, I'm innocent. I'm not the one that shot they own child. It was an Infiniti, a charcoal-gray Infiniti with tint on it."

Police reports show Smith may have exchanged words, and possibly gunfire, with a vehicle while the boy rode his bike in the 2600 block of Mango Circle. Police say a stray bullet struck and severely injured the child.

The boy was driven to the hospital by a neighbor. Family members say the child underwent surgery and is in intensive care at Children's Healthcare of Atlanta at Egleston.

Police say tips from neighbors led them to Smith, who is now charged with aggravated assault. Officer Kim Jones said that Smith was attempting to sell a weapon when, for some reason, he starting firing at the person who was going to buy the gun. The boy was caught in the crossfire.

Smith denied the charges as he was being led out of the police station.
