    The parents of a 4-year-old girl killed in a car crash earlier this month announced plans Wednesday for a $20 million wrongful death lawsuit against the city of New York.
    The parents of a 4-year-old girl killed in a car crash earlier this month announced plans Wednesday for a $20 million wrongful death lawsuit against the city of New York after she and her grandmother were struck by an SUV driven by an unlicensed teen fleeing police.
NEW YORK (MYFOXNY) - The NYC Dept. of Investigation found that human error was to blame for the delay by EMS in responding to the crash that killed Ariel Russo, 4, and seriously injured her grandmother on Manhattan's Upper West Side.

In a report released on Thursday, the DOI said despite problems with the 911 system on other days, there were no technical issues with the system on June 4, the day the SUV driven by Franklin Reyes, 17, an unlicensed driver, plowed into the pair.

Reyes faces charges including manslaughter and unlawful fleeing in a motor vehicle.

Fire Department officials have said that the EMS worker who should have seen the call on her computer had gotten up to go on break which caused a delay of just over four minutes in dispatching an ambulance to the scene.

The EMS worker has denied the call appeared on her screen before she logged off.

Her union blames technical glitches in the new 911 system for the missed call.
