Weenie Wagon’s Rights

Englewood, New Jersey (My9NJ) - Rosie D'Rivera started Rosie’s Weenie Wagon after losing her job and having difficulty finding new employment. Unfortunately, the road for Rosie’s wagon hasn’t always been a smooth one and she’s currently hit a road block with the town of Englewood over her licensing.

You see Rosie has a peddler’s license which requires her to move her vehicle every 15 minutes, but Rosie thinks her business would do much better if she could just stay in one place.

The Institute for Justice is a Civil Liberties Law Firm and they believe Rosie's 14th Amendment Rights are being violated. The 14th Amendment addresses citizenship rights and equal protection of laws and one of their attorney’s, Robert Frommer discussed how Rosie’s situation fits into this.

“The 14th Amendment of the U.S. Constitution gives everyone the right to earn an honest living free from arbitrary and unnecessary government restriction and what that means is if the government tells you that you can’t do something it has to have a real reason, a real health and safety reason. Unfortunately though, Englewood tells her that she has to move every 15 minutes even though she’s on private property,” he explained.

The Institute for Justice has won cases for other food trucks by using this same argument.

“The American dream is about being able to pull yourself up by your boot straps and improving your life and the lives of your community, that’s exactly what Rosie has done here. Englewood should be celebrating that, not trying to throw her out of business,” Frommer said

The town of Englewood however doesn’t feel like they have violated her rights and even issued a statement saying that their attorney does not agree with this legal thought at this time.
