Dept. of Education facing charter school lawsuit

The NYC Dept. of Education is facing a federal civil lawsuit from parents of children at Success Academy Harlem Central charter school who want to keep the city from re-locating its students.

Success Academy founder and CEO Eva Moskowitz announced the lawsuit outside the West 113th St. school on Monday morning.

Nearly 200 students would be displaced under the city's plan. The de Blasio administration has cited concerns over the safety of the special needs children who attend the public school that shares space with Success Academy Harlem Central.

In addition, Mayor de Blasio has said that two additional schools of the Success Academy network would not be allowed to open this fall.

Schools Chancellor Carmen Farina told Good Day New York on Friday that the city was looking for space for the displaced children.

The Dept. of Education issued a response over the weekend:

"The administration is already taking steps to resolve concerns we have received by some parents. In our decisions, we set consistent, objective, commonsense standards-most importantly protecting students with disabilities. We remain deeply committed to the rights of all students, and ensuring every child has access to a great education."

Fox 5 News has learned that Success Academy is also filing two additional complaints regarding the Success Academy City Hall and Success Academy Jamaica.

    The NYPD is looking for a tall, violent thug who is attacking victims in Central Park and dragging them to the ground with chokeholds.The latest attack happened about 12:40 a.m. on Wednesday. Police say the 6' 5" attacker started a conversation with a 47-year-old man in the area of 74th St. and East Drive. He then put the victim in a chokehold, dropped him to the ground and stole his bag.
