High School Student Banned From Prom Over A Tweet

SOMERDALE, N.J. -

A local high school student filed a federal law suit after she's banned from prom, her senior class trip and graduation ceremonies -- all because of a tweet!

Attorney Jerry Tannenbaum says his client is paying big time for exercising her right of free speech. Tannenbaum says the 17 year old student at Sterling High School in Somerdale, New Jersey, used twitter to communicate with friends about her foul feelings towards the high school principal. She's accused of calling him a colorful name later seen by school officials.

But this was done at night, at her home, off of school property to three or four of her friends.

School officials cited the tweet as defamatory in a letter that was sent home to the 17 year old girl's mom. The letter also requires the student be drug tested based on other comments she allegedly posted on the social media site.

Further, the school wrote that the teen "will not be allowed to participate in any school sponsored events this year, including prom, senior trip, and graduation ceremonies".

They wanted to show her who is boss and they're going to show her that they exercise the authority.

He filed a lawsuit against the Sterling High School District in federal court on Friday accusing the district of violating the student's first amendment rights.

"You can't dictate to your students what they can say on their own personal web pages," declares Tannenbaum .

The court documents also explain that the student has a diagnosed behavioral health issue that can cause her to act disrespectful towards authority figures.

Tannenbaum's complaint accuses the district of discriminating again the student due to her disability.

The school district would not comment on the lawsuit. In fact, they would not let us through the front doors to discuss their policies.

The student's attorney says he filed an injunction so the case could be heard in the coming week.

That way the student will at least have a shot at being able to attend some of the senior class events.
