Murder suspect goes before judge; victim is remembered by friends

A security guard and a family man, Edwin Anthony Mercado, is being remembered after he was gunned down at work. The suspected shooter, Miguel Angel Santos-Rivera faced a judge Sunday morning.

The shooting happened Friday 11:30 p.m. at Las Princesas Nightclub in Winter Garden. Rivera and 41-year old Mercado were hired to work security but work for different companies.

Winter Garden Police say an argument ensued between the two men and both of them had guns.  According witnesses, the suspect Rivera took off his gun belt to physically fight with the victim Mercado.

Witnesses also told police Mercado pulled out his gun and aimed it at Rivera but eventually holstered the weapon.  At that point detectives say Rivera took out his gun and shot Mercado in the chest.

Mercado later died at the hospital.

“This was in fact an act of self-defense,” said Rivera’s defense attorney. The 37-year-old started crying during court as the state argued to the judge he should stay in jail with no bond.

“The defendant was seen shooting the victim after the victim put his gun away and he had put his gun in the holster,” said the state prosecutor.

The judge gave Rivera a $250,000 bond but says since Rivera violated his probation The judge says he will not get out of jail at least not any time soon.

Rivera is still currently on probation for a prior felony of drug charges. He was out on bond in Osceola County.

Rivera is expected to have a pre-sentencing hearing Monday morning. The state wants to bring in testimony so the judge may revoke the bond.
