Pretrial hearing for Luis Toledo postponed until September
DELAND, Fla. (WOFL FOX 35 ORLANDO) -
A pretrial hearing for the man accused of killing his wife and her two kids has been postponed. Luis Toledo, 32, was in court on Tuesday, where his lawyer asked for a continuance.
Toledo is accused of killing Yessenia Suarez,28, and her children Thalia Otto, 9, and Michael Otto, 8. The three disappeared in late October and are presumed dead as their bodies have not been found.
The judge agreed to postpone the hearing until September. Toledo's attorney said he would like to push the trial to next year to have more time for depositions.
Toledo is charged with second-degree murder in his wife's killing, and has pleaded not guilty. He remains jailed without bond in the Volusia County Branch Jail.
