Cop who choked man during fatal arrest loses badge

NEW YORK (MYFOXNY) - The police officer seen in a video apparently putting a choke hold on the man who later died has had his gun and badge taken away pending the outcome of investigations into what happened. 

The NYPD announced Saturday that Officer Daniel Pantaleo, an 8-year veteran, has been placed on "modified assignment," pending the outcome of the dual probes by the district attorney and Internal Affairs.

Four medics have also been placed on leave pending the outcome of the investigation. 

Eric Garner had a heart attack and died as officers attempted to arrest him for illegally selling cigarettes on Staten Island and family members are demanding justice.

The victim, 43, was later pronounced dead at a hospital after officers tried to apprehend him around 4:45 p.m., Thursday.

The paper reports that Garner weighed 400 lbs. and was severely asthmatic.

"Are you serious? " he's heard saying to officers attempting to arrest him.

"I did nothing. I've been sitting here the whole time minding my business. Every time you see me you try to arrest me. I'm minding my business officer, please leave me alone," says Garner.

Several other officers arrive on the scene. One of the officers is seen putting Garner in a choke hold as the others slam him to the floor.

Choke holds were banned by the NYPD a few years ago.

"I can't breathe. I can't breathe," says Garner.

The father of six was selling un-taxed cigarettes on Bay Street, just blocks away from the 120th precinct, according to the NYPD.

They say he'd been previously arrested for the same offense. The NY Post reported that Garner had more than 30 arrested on his record.

Reverend Al Sharpton says the video and incident will be a test for the De Blasio Administration. Mayor de Blasio did not attend the rallies but he did call family members to offer condolences..

Garner's family told the mayor they're seeking justice.
